Mira terms.

These Terms of Service ("Terms") are an agreement between you and Justin Bell, an individual sole proprietor based in the United States ("we", "us"), governing your use of the Mira Voice application ("Mira", "the App"). By downloading or using Mira, you agree to these Terms. If you don't agree, don't use the App.
Eligibility
You must be at least the age of digital consent in your country (13–16 in the EU/EEA, depending on national law; 13 in the United States) and able to form a binding contract. Mira isn't directed to children below that age.
Licence
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use Mira for your personal, non-commercial use on Apple-branded devices that you own or control, as permitted by the App Store Usage Rules. You may not copy, modify, reverse-engineer, sell, or distribute the App except as permitted by law.
Accounts
A free account is required to use Mira. You're responsible for activity under your account and for keeping your credentials secure. You may delete your account at any time in the App (Account → Delete account).
Subscriptions (Mira Pro)
- Mira Pro is an auto-renewable subscription sold by Apple as merchant of record and billed to your Apple ID.
- Payment is charged at confirmation of purchase. The subscription renews automatically for the same period unless cancelled at least 24 hours before the end of the current period.
- You can manage or cancel anytime in your Apple ID settings. Current prices are shown in the App before purchase.
- Beta testers may receive a complimentary Pro period; it doesn't auto-charge and converts to the free tier when it ends unless you subscribe.
EU right of withdrawal. If you're an EU/EEA consumer you normally have 14 days to withdraw from a distance contract. Because Mira Pro is digital content/services supplied immediately, by purchasing you expressly request immediate performance and acknowledge that you lose your 14-day right of withdrawal once performance has begun. This doesn't affect your statutory rights in respect of non-conforming digital services.
Refunds. Purchases are processed by Apple; refund requests are handled by Apple under its policies (reportaproblem.apple.com). Your mandatory statutory rights as a consumer are unaffected.
Acceptable use
You agree not to: misuse the service or interfere with its operation; attempt to breach or circumvent security or entitlement controls; use Mira for unlawful purposes; or infringe the rights of others.
Your content and imported audio
You retain all rights to content you create in Mira. You represent and warrant that you own or have all necessary rights to any audio you import. Mira processes imported audio on your device for your personal practice only; don't import or use content you aren't authorized to use. Apple Music playback uses your own subscription via Apple's player; Mira doesn't download, store, or redistribute streamed content.
Copyright. We respect intellectual-property rights. If you believe content or functionality infringes your rights, contact miravoiceapp@gmail.com with details, and we'll respond appropriately.
Our intellectual property
Mira, including its software, design, branding, and content (excluding your content and third-party content), is owned by us and protected by intellectual-property laws. These Terms grant you no rights in our trademarks or brand without our prior written permission.
Third-party services
Mira relies on Apple and Supabase. Your use of those features is also subject to the respective third parties' terms, and you agree to comply with any applicable third-party terms when using Mira.
Health disclaimer
Vocal feedback in Mira is provided for practice and entertainment. It is not professional vocal-health, medical, or therapeutic advice. Stop and consult a qualified professional if you experience pain or discomfort.
Disclaimers
Mira is provided "as is" and "as available," without warranties except those that cannot be excluded by law. Nothing in these Terms excludes or limits the statutory guarantees and consumer rights you have under mandatory law, including the EU consumer rules on conformity of digital content and services.
Limitation of liability
To the maximum extent permitted by law, we're not liable for indirect, incidental, special, or consequential damages arising from your use of Mira. Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for gross negligence or wilful misconduct, or for any liability that cannot be excluded under applicable mandatory law (including your statutory consumer rights). Where liability cannot be excluded but can be limited, it is limited to the amount you paid us (if any) in the 12 months before the event giving rise to the claim.
Termination
You may stop using Mira and delete your account at any time. We may suspend or terminate access if you materially breach these Terms or where required by law, ordinarily with notice where practicable. Provisions that by their nature should survive (e.g. Your content and imported audio, Our intellectual property, Disclaimers, Limitation of liability, Governing law and disputes) survive termination.
Apple App Store terms
These Terms are between you and us only, not with Apple. Apple isn't responsible for Mira or its content. To the extent these Terms function as your end-user licence for the App:
- Scope. Your licence is limited to use on Apple-branded products you own or control and as permitted by the Usage Rules in the App Store Terms of Service.
- Maintenance and support. We're solely responsible for any maintenance and support; Apple has no obligation to furnish it.
- Warranty. We're solely responsible for any product warranties to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
- Product claims. We, not Apple, are responsible for addressing any claims relating to the App, including product-liability, legal/regulatory, consumer-protection, and privacy claims.
- Intellectual property. In the event of a third-party claim that the App infringes intellectual-property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.
- Legal compliance. You represent that you're not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and that you're not on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

Changes
We may update these Terms. For material changes we'll provide reasonable notice (for example, in the App or by updating the date above). Your continued use after the changes take effect constitutes acceptance; if you don't agree, stop using Mira.
Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without prejudice to the mandatory consumer-protection rules of your country of habitual residence. If you're a consumer, you may bring proceedings in the courts of your place of residence, and we'll bring any proceedings against you there. We encourage you to contact us first at miravoiceapp@gmail.com so we can try to resolve any dispute amicably.
